Terms and Conditions for Mad Lad Visuals

Welcome to Mad Lad Visuals. By using this website or booking our photography services, you agree to be bound by the following Terms and Conditions. These Terms are designed to protect both you (the “Client”) and Mad Lad Visuals (the “Creator”) and ensure a clear understanding of expectations.

1. Services

Mad Lad Visuals offers photography services including, but not limited to, commercial, corporate event, branding, and portrait photography. Specific services and deliverables will be outlined in a signed Photography Service Agreement for each booking.

2. Booking and Payment

  • A signed agreement and non-refundable retainer (25% of the total service fee) are required to secure your booking date.

  • Final payment is due by the calendar day before the scheduled event.

  • Late payments may incur a $50 fee. Returned checks are subject to a $100 fee.

  • Payment Methods

    Mad Lad Visuals accepts the following payment methods for all services:

    • Cash (in person only)

    • Credit Cards (via secure online invoice)

    • Electronic Bank Transfers (Zelle, PayPal, Venmo, or other approved services)

    • Apple Pay

    • CashApp

    • Checks (payable to Mad Lad Visuals)

    All payments must be made in full according to the payment schedule outlined in your contract. Returned checks are subject to a $100 fee. Work will not be delivered until full payment is received.

3. Rescheduling & Cancellations

  • Clients may request to reschedule with at least seventy-two (72) hours’ notice.

  • Only one rescheduling is permitted per agreement.

  • Rescheduling is subject to availability and must be confirmed in writing.

  • Requests made with less than 72 hours’ notice may be treated as cancellations.

  • Cancellations by the Client result in forfeiture of the retainer.

  • In the rare event that Mad Lad Visuals must cancel, we will refund all payments made.

4. Artistic Style & Creative Control

By booking with Mad Lad Visuals, you acknowledge our artistic style and grant us full creative discretion. Final images may differ from past work and personal expectations. No RAW or unedited files will be provided.

5. Copyright & Usage

Mad Lad Visuals retains full copyright ownership of all work. Upon full payment, Clients receive a non-exclusive license for personal or business use as outlined in their agreement. Commercial use beyond the agreed scope requires additional licensing.

6. Delivery & Storage

  • Edited digital images are delivered within two (2) weeks unless otherwise agreed.

  • We store backups for six (6) months. After that, file storage is not guaranteed.

  • Physical storage devices (e.g., USB) are available for an additional fee.

7. Safety & Conduct

We reserve the right to leave a shoot or event if any team member feels unsafe due to harassment, threats, or illegal behavior. No refunds will be issued under such circumstances.

8. Travel & Accommodations

Events more than 50 miles from Elk Grove, CA may incur travel and accommodation fees. Mileage is billed at the current IRS rate plus 50%.

9. Client Responsibilities

Clients must provide accurate details and be punctual. Unplanned delays may reduce coverage time or incur extra fees.

10. Limitation of Liability

In the event of technical failure or loss of images, Mad Lad Visuals' liability is limited to refunding all payments made. We are not responsible for consequential damages.

11. Dispute Resolution

These Terms are governed by the laws of California. Any disputes will be resolved in Sacramento County courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of our website or services indicates your acceptance of any changes.
